Attorney General Coleman Takes on the EPA in the Sixth Circuit Over Radical Climate Agenda

CINCINNATI, Ohio (May 8, 2024) Attorney General Russell Coleman released the following statement after the office’s Solicitor General Matt Kuhn presented oral argument before the U.S. Court of Appeals for the Sixth Circuit challenging the EPA’s overreach into Kentucky over the regulation of air quality:

“The Biden Administration has once again put politics over all else and Kentucky families will pay the price. Our country’s air quality is at its cleanest point on record, and we in Kentucky are prepared to be good stewards of our air, land and water. Instead of trying to regulate our affordable and reliable Kentucky energy out of existence, the Biden Administration should refocus on violent crime, deadly drugs and enemies of freedom around the globe.

“The Sixth Circuit has already sided with hardworking Kentuckians once in this case. We are back in court today to defeat this terrible EPA decision once and for all.”

Background

Last June, the Sixth Circuit temporarily blocked the Biden Administration’s EPA from rejecting Kentucky’s proposal to regulate air quality within its borders. If allowed to take effect, the Biden Administration-imposed regulation would undermine Kentucky’s jobs, potentially shut down coal-fired power plants and increase costs for families.  

Following today’s arguments, the three-judge panel will decide whether to continue blocking the job-killing rule or to allow the Biden Administration’s EPA to overregulate Kentucky.
