FRANKFORT, Ky. (Sept. 3, 2026)– Attorney General Russell Coleman announced today the filing of a civil lawsuit against New York-based activist organization Mayday Health for breaking Kentucky law by advertising illegal mail order abortion pills. Mayday Health has advertised these deadly drugs at gas stations and with a banner attached to an airplane over the Kentucky State Fair.
Attorney General Coleman’s lawsuit, filed in Logan Circuit Court, details Mayday Health’s violations of Kentucky’s Consumer Protection Act. The lawsuit asks the court to order the organization to permanently stop its illegal advertisements and to pay penalties.
“These out of state activists are not only breaking Kentucky law, they seem to delight in rubbing our faces in it.” said Attorney General Coleman. “The State Fair is a beloved Kentucky tradition for families and children to celebrate our Commonwealth. We refuse to allow Mayday to taint our values and put our people at risk.”
In January, Attorney General Coleman announced a civil investigation into Mayday Health’s advertisement at Western Kentucky gas stations, including in Christian, Simpson and Logan counties.
In 2022, the General Assembly prohibited the mailing or delivery of abortion-inducing drugs in Kentucky. In addition, Kentucky’s Consumer Protection Act prohibits deceptive or misleading communications with Kentuckians.
Any Kentuckian who sees one of these advertisements or suspects any other unlawful business activity is encouraged to report it to the Attorney General’s Office of Consumer Protection here.
